These terms apply to the Harbor website, downloads, and desktop software (together, the “Services”). Harbor is a product from CADCS Technology (“CADCS,” “we,” or “us”). By using the Services, you agree to these terms. If you do not agree, do not use them.

1. Who may use Harbor

You must be legally able to agree to these terms where you live. If you use Harbor for an organization, you confirm that you are authorized to accept these terms for it.

2. Software license

Subject to these terms and any plan or purchase conditions shown to you, CADCS grants you a limited, non-exclusive, non-transferable license to download, install, and use Harbor for your personal or internal business purposes. The license does not transfer ownership of Harbor to you. You may not sell, sublicense, or redistribute Harbor, or remove its proprietary notices, except where we expressly permit it or applicable law gives you a right to do so.

Harbor may include components governed by separate open-source or third-party licenses. Those licenses apply to their components and take precedence where required.

3. Your systems and responsibilities

You are responsible for the computers, servers, cloud accounts, credentials, files, and networks you connect to Harbor, and for having permission to access and manage them. Keep backups of important data and protect your credentials and device.

Harbor provides tools for managing remote systems. You remain responsible for reviewing commands and changes before executing them, selecting the correct host, and assessing their impact. Any warnings or production guardrails are aids, not a guarantee that every risky action will be detected or prevented. Use particular care with production systems.

4. Acceptable use

You may not use the Services to break the law, access systems without authorization, interfere with or disrupt systems or networks, distribute malware, or infringe another person’s rights. You may not circumvent technical restrictions or attempt to compromise the Services. Nothing in these terms restricts rights that applicable law does not allow us to restrict.

5. Plans, prices, and payments

Plan descriptions and prices on the website are informational. This website currently does not take payment or create a paid subscription or license purchase. A plan becomes binding only if we later offer a checkout or other purchase flow and you complete it; that flow may provide additional terms, billing details, renewal and cancellation rules, and applicable taxes. If those terms conflict with this section for a purchase, the purchase terms control. Mandatory consumer rights remain unaffected.

6. Third-party services

Harbor may connect to services or systems you choose, such as cloud providers, and the website may link to third-party sites. Those services are governed by their own terms and privacy notices. CADCS does not control third-party services and is not responsible for their availability, security, or practices.

7. Ownership and feedback

CADCS and its licensors retain all rights in Harbor, including its software, design, and branding, except for the limited license granted above. If you send us suggestions, you allow us to use them without restriction or payment, provided this does not take away rights you already have in your materials.

8. Availability and changes

We may update, change, suspend, or discontinue parts of the Services, and may release updates to Harbor. We do not promise that every feature will always be available or that the Services will be uninterrupted or error-free. We will update these terms when they materially change; the date above shows when they were last revised. Continued use after an update means you accept the revised terms, to the extent permitted by law.

9. Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available,” without warranties or conditions not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. These terms do not exclude any warranty or consumer protection that cannot legally be excluded.

10. Liability

To the extent permitted by law, CADCS is not liable for indirect, incidental, special, consequential, or punitive loss, loss of profits, data, or business, or damage resulting from your use of Harbor to access or change a system. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or for death or personal injury caused by negligence where applicable law prohibits that exclusion.

11. Suspension and termination

You may stop using the Services at any time and uninstall Harbor. We may suspend or end access if reasonably necessary to address misuse, a security risk, or a legal requirement. Provisions that by their nature should continue after use ends will continue, including those on ownership, disclaimers, liability, and disputes.

12. Governing rules and contact

These terms do not remove any mandatory rights or protections available to you under the laws that apply where you live. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
